These Terms & Conditions ("Terms") govern your access to and use of the website located at punjaborigin.com (the "Site"), operated by or on behalf of Punjab Origin ("Punjab Origin," "we," "us," or "our"), the recording and performing artist project, operated by Gurjot Singh. Please read these Terms carefully before using the Site.

1. Acceptance of These Terms

By accessing, browsing, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use the Site.

If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Eligibility

The Site is intended for users who are at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher). If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian.

3. Intellectual Property

3.1 Our Content

All content made available on or through the Site — including but not limited to sound recordings, musical compositions, audiovisual works, music videos, visual art, photography, animation, AI-assisted and digitally produced artwork, graphics, logos, typography, text, design elements, and the overall look and feel of the Site (collectively, "Content") — is owned by or licensed to Punjab Origin and/or its label, distributor, and partners, and is protected under the Copyright Act, 1957 (India), the Trade Marks Act, 1999 (India), and applicable international copyright, trademark, and intellectual property laws and treaties.

3.2 Name, Marks & Visual Identity

"Punjab Origin," the Punjab Origin logo, and the associated visual identity — including the artist's masked visual persona, stage imagery, and related artwork — are trademarks and/or trade dress of Punjab Origin / Gurjot Singh. Nothing in these Terms grants you any right to use any name, mark, persona, or likeness associated with Punjab Origin without our prior written consent.

3.3 Limited License to You

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Site and stream or view the Content solely for your personal, non-commercial entertainment. This license does not permit you to:

  • download, copy, reproduce, rip, record, or capture any audio or audiovisual Content except where a download function is expressly provided;
  • distribute, publicly perform, publicly display, broadcast, or communicate the Content to the public;
  • modify, adapt, remix, sample, translate, or create derivative works from the Content;
  • use the Content for any commercial purpose, including synchronization with other media, advertising, or monetized uploads on any platform;
  • use any Content, imagery, or the artist's voice or likeness to train, fine-tune, or develop any machine learning or artificial intelligence model, or to generate derivative AI output;
  • remove, obscure, or alter any copyright notice, watermark, or attribution.

Any use of the Content not expressly permitted by these Terms is prohibited and requires prior written permission. For licensing, synchronization, sampling, or press enquiries, contact us at gurjot@rthyms.com.

4. Acceptable Use

You agree that you will not, and will not attempt to:

  • use the Site in any way that violates applicable law or regulation, including the Information Technology Act, 2000 (India) and rules thereunder;
  • access, scrape, crawl, or index the Site or Content by automated means without our prior written consent;
  • interfere with or disrupt the operation of the Site, its servers, or networks, including by transmitting viruses, malware, or any harmful code;
  • circumvent, disable, or interfere with any security, access-control, or content-protection feature of the Site;
  • impersonate Punjab Origin, any member of the artist's team, or any other person, or misrepresent your affiliation with any person or entity;
  • frame, mirror, or embed any part of the Site without our prior written consent;
  • use the Site to harvest or collect personal information about other users.

We reserve the right to suspend or terminate your access to the Site, without notice, for any breach of this Section.

5. Fan Submissions & Communications

If you submit, post, or send us any material — including fan art, remixes, covers, demos, messages, comments, or ideas ("Submissions") — you agree that:

  • your Submission is voluntary and non-confidential, and creates no fiduciary or contractual relationship;
  • you own or control the rights in your Submission and it does not infringe any third party's rights;
  • you grant Punjab Origin a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, and share your Submission in connection with the artist project and its promotion (for example, resharing fan art on social media, with credit where practicable);
  • unsolicited music demos: to avoid future disputes, we do not accept unsolicited demos, beats, lyrics, or song ideas through this Site. Any such material sent to us is deemed unsolicited, will not be reviewed, and creates no obligation of any kind. Punjab Origin's works are created independently, and any similarity to unsolicited material is coincidental.

6. Music, Streaming & Third-Party Platforms

The Site may embed or link to third-party platforms and services, including Spotify, Apple Music, YouTube, Instagram, and other streaming, social, ticketing, or merchandise services. Your use of those platforms is governed by their own terms and privacy policies, not ours. We do not control and are not responsible for the content, availability, accuracy, policies, or practices of any third-party platform. Embedded players (such as Spotify or YouTube embeds) may set cookies or collect data as described in those platforms' policies.

7. Merchandise & Purchases

If and when merchandise, tickets, or other products are offered through the Site, additional terms of sale (covering pricing, taxes, shipping, returns, and refunds) will apply and will be presented at the point of purchase. Where purchases are processed by a third-party provider, that provider's terms also apply.

8. Newsletter & Updates

If you subscribe to receive updates, you consent to receive communications about releases, shows, and announcements. You may unsubscribe at any time using the link in any email. Handling of your personal data is described in our Privacy Policy.

9. Privacy

Our collection and use of personal information through the Site — including any analytics, cookies, and embedded third-party content — is described in our Privacy Policy, which complies with applicable law including the Digital Personal Data Protection Act, 2023 (India), to the extent applicable.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Release dates, show dates, and other announcements on the Site are subject to change without notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Punjab Origin, Gurjot Singh, and their respective members, managers, employees, partners, label, distributors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Site or any Content, even if advised of the possibility of such damages.

To the extent any liability cannot be excluded, our aggregate liability arising out of or relating to the Site shall not exceed INR 1,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Punjab Origin and Gurjot Singh from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site or Content, or your violation of any law or third-party right.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to any mandatory consumer protections available in your place of residence, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.

14. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the latest version. Material changes will be indicated by updating that date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms. If you do not agree to a revision, you must stop using the Site.

15. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.

16. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented for specific features (such as purchases), constitute the entire agreement between you and Punjab Origin regarding the Site.
